1. Who we are

By placing an order or using this site, you agree to these terms. Please read section 3 carefully before you wear the brace.
2. Who can order
You must be at least 18 years old to order from us. Our products are not intended for anyone under 18.
3. What Nightform is, and what it is not
Nightform is a bunion brace — a supportive device you wear over the foot while you sleep. In the United States a night bunion splint of this kind is a Class I medical device (a limb orthosis, 21 CFR 890.3475), exempt from premarket review.
It is not a medicine and it is not surgery. Nothing on this site is medical advice, and nothing we say is intended to diagnose, treat, cure or prevent any condition. A brace holds and supports the joint overnight. It does not remove a bunion and it cannot straighten bone.
Do not use Nightform if you have broken skin, an open sore or an active infection on the foot.
Speak to a doctor or podiatrist first if you have diabetes, poor circulation, or reduced feeling in your feet — you may not notice a strap that is too tight.
Stop wearing it and get advice if you get numbness, tingling, colour changes in the toes, skin damage, or pain that is getting worse.
Start gently. Tension is set by you, with the dial, and more is not better.
4. Prices and orders
All prices are shown in US dollars.
Prices do not include any sales tax that may apply. Where we are required to collect sales tax, it is calculated and shown at checkout before you pay.
We may change our prices at any time. A price change never affects an order that has already been placed.
We may refuse or cancel an order, including after it has been confirmed, if the product is unavailable, if the price or product information was listed incorrectly, or if we suspect fraud. If we cancel an order you have already paid for, we refund it in full.
5. Shipping and risk
Our delivery times, destinations and shipping costs are set out in our shipping policy, which forms part of these terms. Shipping is free on every order.
Risk of loss passes to you when the carrier delivers the parcel to the address you provided. Please make sure your delivery address is correct — we cannot recover a parcel that has been delivered to an address you entered incorrectly.
6. Returns and refunds
You have 30 days from the day your order arrives to change your mind. Email us at info@wearnightform.com, send the brace back unworn and in its original packaging, and we refund the order in full. We send you a prepaid return label; you do not pay shipping in either direction.
Because the brace is worn against bare skin overnight, we can only accept a return that has not been slept in. Trying it on to check the fit does not count as worn; sleeping in it does. This applies once per customer or household.
That condition does not apply to anything faulty, damaged, incomplete or incorrect. If a brace arrives wrong or a strap, hinge or dial fails in normal use, we replace or refund it whether or not you have worn it, and you pay nothing either way.

Your rights under the consumer law where you live — including your rights when something is faulty or not as described — apply in addition to this policy, not instead of it.
7. Your account
You are responsible for keeping your account details and password secure, and for everything that happens under your account.
Tell us as soon as possible if you think someone else has access to it.
8. Acceptable use
You may not use this site to break the law, to interfere with the site or its security, to scrape or copy it for a competing service, or to resell our products without our written permission.
9. Our content
The text, images, product names, logos and design on this site belong to us or to our licensors. You may not copy or reuse them commercially without our written permission.
10. Reviews and content you submit
If you send us a review, a photo or a message, you give us permission to publish it in connection with the product.
We publish reviews as they are written and we do not pay for them. Please do not submit anything that is not yours to share.
11. No warranty beyond what is set out above
Beyond the return policy in section 6 and any rights you have by law, this site and its content are provided as they are. We do not promise that the site will always be available or free of errors.
We do not promise a particular result from wearing the brace. How a bunion responds differs from person to person, and a brace is support, not a cure.
12. Limitation of liability
To the maximum extent permitted by law, our liability for any claim relating to a product or to this site is limited to the amount you paid for the order in question. We are not liable for indirect or consequential loss.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
13. Governing law and disputes
These terms are governed by the law of the Netherlands, where Base Works is established, and disputes are subject to the courts of the Netherlands.
This does not take away any rights you have under the mandatory consumer law of the place where you live, or your right to bring a claim in the courts of that place where the law gives you that right.
If something goes wrong, please email us first at info@wearnightform.com. Most issues are resolved within a few days without anything formal.
14. General
If part of these terms does not apply. If any part of these terms is found to be invalid or unenforceable, that part is removed and the rest of the terms stay in force.
These terms as a whole. These terms, together with our shipping policy, refund policy and privacy policy, make up the full agreement between you and us about your order.
Transferring this agreement. We may transfer our rights and obligations under these terms to another business, for example if our business is sold. Your rights under these terms are not affected.
If we do not enforce something immediately. If we delay in enforcing any part of these terms, we do not lose the right to enforce it later.
15. Changes to these terms
We may update these terms. The version published on this page at the time you place your order is the version that applies to that order.
